Property Law Generally & the Restatement of the Law

Property is a fundamental concept of Anglo-American law. An overview of the law of property as it has developed can be found by researching the Restatement of the Law of Property. The Restatement of Property has evolved over the years in several editions. Due to this evolution over time, the Restatement can be challenging to cite and to use. The American Law Institute maintains a list of the most current editions for all of the Restatements of Law:

Constitutional Law

United States Constitution
The Fifth Amendment to the U.S. Constitution prohibits the deprivation of property rights without due process of law as well as requiring compensation for the taking of private property as in the case of eminent domain where a municipality seizes land.

Minnesota Constitution
Similarly, Article I, Section 7 of the Minnesota State Constitution prohibits the deprivation of property without due process of law.
